Pretrial Diversion Programs

Pretrial diversion programs in Orange and Osceola counties are overseen by the Ninth Judicial Circuit’s Office of the State Attorney. Each program has its own specific eligibility criteria and requirements in addition to those set by the state.

For instance, the drug diversion program has several tiers depending on the offense. Participants may be required to complete a drug education course or undergo six to 12 months of court supervision. For DUI cases, eligibility typically excludes individuals with prior DUI convictions or a history of dangerous driving.

While each program varies, general requirements often include:

  • Attending all court dates and supervisory appointments
  • Paying fines and program fees
  • Passing drug and alcohol screenings as needed
  • Completing community service hours
  • Attending mandatory classes or rehabilitation programs
  • Avoiding further legal issues

Failure to meet these conditions could result in removal from the program, requiring you to return to court and face prosecution for your original charges.
